Terms of service
These terms are a binding agreement between you and Fayted (“we,” “us,” “our”) covering your use of fayted.app and everything that links to them (the “Services”). By using the Services you agree to them. If you do not agree, please do not use Fayted.
You can reach us at info@fayted.app.
You must be 18 or over to use Fayted. People under 18 may not use or register for the Services.
We may change these terms. If we do, we will update the date at the top, and material changes will be announced in the app. Continuing to use the Services after a change means you accept it.
1. Our services
Fayted is free. You post an anonymous message about someone you crossed paths with, tied to a place. Other people can read it. If someone believes it is about them, they answer a verification question you wrote, and you decide whether to open a private chat.
The Services are operated from and hosted in the United States. If you use them from elsewhere, you do so on your own initiative and are responsible for compliance with your local laws. The Services are not designed to meet the requirements of sector-specific regulations such as HIPAA or GLBA, so do not use them for information those laws govern.
2. Our intellectual property
We own or license the software, design, text, and graphics that make up the Services, along with the Fayted name and marks. You may use the Services, and view and print content you have properly accessed, for your own personal, non-commercial use. Everything else — copying, redistributing, reselling, scraping into a database, or building a competing service from our content — requires our written permission.
This section does not apply to content you write. That is covered in section 6.
3. What you promise us
By using the Services, you confirm that:
- you are at least 18 years old;
- the information you give us is accurate, and you will keep it accurate;
- you have the legal capacity to agree to these terms;
- you will not use bots, scripts, or other automated means to access the Services;
- you will not use the Services for any unlawful purpose.
If you give us information that is untrue or incomplete, we may suspend or close your account.
4. Your account
To post, answer a post, or send a message you need an account. Accounts are created with a mobile phone number, verified by a code we text you. There is no password. Anyone with access to your phone number and its messages can access your account, so keep your device and number secure, and tell us promptly if you lose control of either.
You are shown to other people under an automatically generated pseudonym, not your name. We may change a pseudonym you have edited if it impersonates someone, contains contact information, or is otherwise objectionable.
5. Things you may not do
You agree not to:
- scrape, harvest, or systematically collect content or accounts from the Services, by any means, into any collection or database;
- use anything you learn on Fayted to harass, stalk, threaten, or harm another person;
- impersonate anyone, or use another person’s pseudonym;
- use the Services to advertise, sell anything, or run any commercial activity;
- post spam, repeated content, or anything designed to disrupt the Services;
- interfere with security features, attempt to access accounts or data that are not yours, or probe our systems except as invited by our security contact;
- reverse engineer, decompile, or copy the software behind the Services, except where the law permits it;
- create accounts by automated means, or evade a suspension by making a new account;
- use the Services in a way that breaks any applicable law.
6. Content you write
In short: you own what you write. We need permission to show it, and that permission ends when you delete it.
You keep ownership of your posts and messages. We do not claim them.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute the content you post, in order to operate and promote the Services. Showing your post to other people is the entire point of the app, and that is what this permission covers. It includes generating share previews and link cards for public posts, because that is how a post reaches the person it is about.
It also means we may feature public posts in our own channels. A post you make public may appear in material promoting Fayted — for example on our own social accounts — shown as the post text with its place and date. This is one of the main ways people find Fayted, and it is often how a post reaches the person it is about.
Four limits on that licence, which we consider binding:
- Only public posts. We never use private messages, the answers people send when claiming a post, or anything that is not already public on Fayted.
- It ends when you delete. Delete a post, or your account, and the licence over that content ends. We remove it from the Services, including any share images we generated from it, and we take it down from our own channels too.
- You can opt out at any time. Email us and say you would rather a particular post, or any of your posts, were not featured. We will honour that, and you do not have to give a reason.
- We do not sell your content and we do not put it into third-party advertising. There is no advertising on Fayted, and we do not licence your posts to anyone else.
If you are the person a post is about and you would rather it were not featured, the same opt-out applies to you — and you can have the post removed entirely under section 8.
Two things we cannot honestly promise around. Copies other people have already made — a screenshot, a link they sent a friend — are outside our control once they exist. And deleted content may persist briefly in encrypted backups until those rotate.
Posts do not stay up forever. They leave public view over time by design. That is a feature, not a failure.
You are responsible for what you post. By posting you confirm the content is yours to post, that it does not infringe anyone else’s rights, and that it is not illegal, harassing, hateful, defamatory, sexually explicit, deceptive, or otherwise in breach of these terms. We may remove or refuse to publish anything that is, and we may suspend accounts that do it repeatedly.
If you send us feedback, suggestions, or ideas about the Services, we may use them without owing you anything for them.
7. Content about other people
In short: Fayted only works because posts are about someone else. That makes this the most important section here.
Every post on Fayted is about a person who has not agreed to be written about. Write with that in mind.
Describe the moment, not the person’s identity. Do not include a full name, workplace, school schedule, home or neighbourhood address, phone number, or social media handle. Do not stack details until someone becomes findable by a stranger who was not there.
Do not post about someone at work. No staff, bartenders, security, teachers, or anyone else doing their job.
Do not post about anyone you believe may be under 18.
Do not post about someone who has asked you to stop. Fayted is not a route around a block, and it is not a place to contact someone who does not want to hear from you.
Posts are reviewed before publication and we will reject or remove ones that break these rules. That review is a backstop, not a substitute for your own judgement, and it does not make an inappropriate post acceptable just because it got through.
8. If someone posts about you
You can have it removed, and you do not need an account to ask. Email info@fayted.app with a link to the post, or enough detail for us to find it. You do not have to explain why or prove it is you.
We will take it down. If the post also harasses you, contains your contact details, or comes from someone you have asked to leave you alone, tell us and we will act on the account as well as the post.
If you are in immediate danger, contact your local emergency services first. We are not an emergency service and cannot respond at that speed.
9. Meeting people
In short: we do not check anyone, and what happens when you meet is between the two of you. Please read this part.
We do not check anyone. We do not verify identity, run background checks, screen criminal records, or confirm that anybody is who they say they are. Answering a verification question correctly shows that someone knew the answer. It does not prove who they are, and it is not a recommendation from us.
You decide whether to meet, and you accept the risk of doing so. Meeting someone you found online carries risk. By using Fayted you accept that risk, and you agree that we are not responsible for the conduct of any user, online or in person. To the fullest extent permitted by law, you release us from claims arising out of your interactions with other users, including anything that happens when you meet.
Before you meet someone from Fayted:
- meet somewhere public the first time;
- tell a friend where you are going and who you are meeting;
- arrange your own way there and back;
- keep your home address and other details to yourself until you are ready to share them;
- if something feels wrong, leave. You do not owe anyone an explanation.
Use the tools. You can block and report someone from their first message onward. If a person makes you uncomfortable, tell us — we would far rather hear about it early than after something has gone wrong.
If you are in danger, contact your local emergency services. We are not an emergency service and cannot respond at that speed.
10. Managing the Services
We may, but are not obliged to, monitor the Services for breaches of these terms, take legal action against anyone who breaks them, refuse or restrict access to any content, and otherwise manage the Services to protect them and keep them working. We have no obligation to monitor every piece of content, and not removing something does not mean we approve of it.
11. Privacy
Our privacy policy explains what we collect and why, and forms part of these terms. The Services are hosted in the United States; by using them you consent to your information being processed there.
12. Copyright
If you believe something on the Services infringes a copyright you own or control, email us at info@fayted.app with enough detail to identify the work and the material you say infringes it. You may be liable for damages if you knowingly misrepresent that something is infringing, so if you are unsure, take advice first.
13. Suspension and termination
These terms apply for as long as you use the Services. We may suspend or close your account, or remove content, at our discretion — including without prior notice where someone’s safety is at stake or where these terms have been broken. If we close your account, you may not open a new one to get around it.
You can close your account at any time. Doing so removes your posts, claims, and messages, as described in section 6 and in the privacy policy.
14. Changes and interruptions
We may change, suspend, or discontinue any part of the Services at any time. We cannot guarantee the Services will always be available — maintenance, faults, and outages happen — and we are not liable for loss or inconvenience caused by downtime. Nothing here obliges us to keep the Services running.
15. Governing law
These terms and your use of the Services are governed by the laws of the State of California, without regard to its conflict of law rules.
16. Disputes
Talking first
If a dispute arises, both of us agree to try to resolve it informally first. Either side can start that by writing to the other, and we both agree to spend at least thirty days trying before starting arbitration.
Arbitration
If informal resolution fails, disputes will be resolved by binding arbitration rather than in court. You understand that this means giving up the right to sue in court and to a jury trial. Arbitration will be conducted under the Commercial Arbitration Rules of the American Arbitration Association, and where applicable its Supplementary Procedures for Consumer Related Disputes, both available at the AAA website. It may take place in person, by phone, online, or on documents, in the State of California.
Limits
Arbitration is limited to the dispute between the two of us individually. There is no right to arbitrate on a class-action basis or on behalf of the general public.
What is excluded
These provisions do not apply to disputes about intellectual property rights, claims of theft, piracy, invasion of privacy, or unauthorised use, or to any claim for injunctive relief. Those may go to court in California, and both of us consent to that jurisdiction.
Any dispute must be brought within one year of the events giving rise to it.
17. Disclaimer
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS, AND YOUR USE OF THEM IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT VERIFY THE IDENTITY OF ANY USER AND WE DO NOT WARRANT THAT A PERSON WHO ANSWERS A VERIFICATION QUESTION IS WHO THEY CLAIM TO BE. WE MAKE NO WARRANTY ABOUT THE ACCURACY OF ANY CONTENT POSTED BY USERS, AND WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, ONLINE OR OFFLINE.

18. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR ANYONE ACTING FOR US WILL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
BECAUSE THE SERVICES ARE FREE, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100.00). SOME STATES DO NOT ALLOW THESE LIMITATIONS, IN WHICH CASE SOME OR ALL OF THEM MAY NOT APPLY TO YOU AND YOU MAY HAVE ADDITIONAL RIGHTS.
19. Indemnification
You agree to defend and indemnify us against any claim brought by a third party arising out of the content you post, your use of the Services, your breach of these terms, your violation of anyone else’s rights, or any harmful act toward another user you connected with through Fayted. We may take over the defence of any such claim at your expense, and you agree to cooperate.
20. Your data
We keep data you send to the Services in order to run them, and we take regular backups. You remain responsible for the content you post. We are not liable to you for loss or corruption of that content, though we will make reasonable efforts to avoid it.
21. Electronic communications
Using the Services and emailing us are electronic communications. You consent to receive communications from us electronically, and you agree that electronic notices, agreements, and records satisfy any legal requirement that they be in writing.
22. Text messages
In short: this is Fayted’s messaging programme. We use Twilio to deliver the messages, but the messages are ours.
By verifying your phone number you agree to receive texts from Fayted. What we send:
- a sign-in code when you log in;
- a notification when someone answers your verification question, when a match is approved, or when you receive a first message;
- if you opt in separately, occasional updates about places you have followed.
Message frequency depends on your activity. Message and data rates may apply, set by your carrier, and carriers are not liable for delayed or undelivered messages.
Reply STOP to any message to stop receiving them, or HELP for help. You can also change your notification preferences in your account settings. Note that stopping texts will prevent you from signing in, because sign-in codes arrive by text.
23. California users
If a complaint is not resolved to your satisfaction, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
24. Everything else
These terms, together with the privacy policy, are the whole agreement between us. If we do not enforce a provision, that is not a waiver of it. If any provision is found unenforceable, the rest still applies. We may transfer our rights and obligations under these terms; you may not. These terms do not create a partnership, employment, or agency relationship between us.
